USER AGREEMENT & TERMS OF SERVICE

Article 1. User Content Responsibility
Content posted by users on Kocard represents only the user's personal position and views and does not represent the position or views of Kocard. As the publisher of the content, you are solely responsible for the content you post. You shall bear full legal liability for all disputes arising from your posted content, and Kocard shall not bear any legal liability. If users publish content on Kocard that infringes upon the intellectual property rights or other legitimate rights and interests of others, Kocard reserves the right to remove such content and refers the matter to judicial authorities for further processing.
Article 2. Prohibited Conduct and Content
Users shall not use Kocard to send or disseminate sensitive information or information that violates national laws and regulations. If a user's behavior does not comply with these Terms of Service, Kocard will make an independent judgment and immediately suspend or terminate the user's service account. Users are fully liable for their actions, and Kocard shall not bear any legal liability.
Users are strictly prohibited from using Kocard to produce, upload, copy, publish, disseminate, or share content that:

a. Violates the fundamental principles established by the Constitution;

b. Endangers national security, leaks state secrets, subverts state power, or undermines national unity;

c. Harms national honor and interests;
-
d. Incites ethnic hatred or ethnic discrimination, or undermines ethnic unity;

e. Undermines national religious policies or promotes cults and feudal superstitions;
-
f. Spreads rumors, disturbs social order, or undermines social stability;
-
g. Spreads obscenity, pornography, gambling, violence, murder, terror, or instigates crimes;
-
h. Insults or slanders others, or infringes upon the legitimate rights and interests of others;
-
i. Contains other content prohibited by laws and administrative regulations.
Article 3. Supervision and Enforcement
Kocard reserves the right to review and supervise your use of Kocard. If a user violates any of the above regulations while using Kocard, Kocard or its authorized representatives have the right to request the user to rectify the behavior or directly take all necessary measures (including but not limited to modifying or deleting content posted by the user, or suspending or terminating the user's right to use Kocard) to mitigate the impact of the user's misconduct.
Article 4. Intellectual Property Rights

Kocard’s Intellectual Property: The products and services provided by Kocard (including any development and upgrades)—including but not limited to source code, object code, documentation, interface design, layout framework, and any software or data provided by Kocard for maintenance and technical support—are protected by copyright, trademark, and other laws. You acknowledge Kocard's ownership and intellectual property rights and promise to respect and not infringe upon them in any way. Without the written permission of the relevant rights holders (Kocard and other original rights holders), you may not copy, disseminate, transfer, license, or provide others with the use of the above intellectual achievements, or use them for any other commercial purposes. Otherwise, you shall bear corresponding liabilities, and Kocard has the right to terminate your use of Kocard without refunding any fees.

User’s Intellectual Property: You retain copyright and other relevant rights to the lawful content you create and post on Kocard in accordance with the law.

Authorized Content: You retain corresponding rights to lawful content for which you have obtained legal authorization and posted on Kocard.

Infringement Policy: If you post content on Kocard that infringes upon the intellectual property rights or other legitimate rights of others, Kocard has the right to delete it and reserves the right to refer the matter to judicial authorities.
Article 5. Modification and Termination of Services

Maintenance Notices: If network services need to be suspended or service functions adjusted due to system maintenance or upgrades, Kocard will, whenever possible, provide prior notice on the website.

Termination for Breach: In any of the following circumstances, Kocard has the right to unilaterally interrupt or terminate the provision of services to the user without prior notice:

a. The user provides false personal information or violates the rules regarding personal information provision;

b. The user violates laws, regulations, these Terms of Service, or relevant service rules;

c. The user violates public order and good customs or disrespects social public morality.

Service Continuity: You understand and agree that Kocard does not guarantee the permanent provision of any specific service due to technical upgrades, service system upgrades, business strategy adjustments, or compliance with major national technical or policy changes. Kocard may change the form, specifications, or other aspects of the services provided. Before suspending such services or making such changes, Kocard will make its best effort to provide prior notice via website announcements, internal messages, emails, or SMS, and reserve reasonable time for you to handle subsequent matters, including but not limited to providing reasonable ways to save information.
Article 6. Disclaimer of Warranties and Liability

Service Interruptions: Given the special nature of internet services, you agree that Kocard may interrupt or terminate part or all of the network services after reasonable notice, and this may cause certain service failures, interruptions, delays, or instability. You assume this risk and agree not to hold Kocard liable.

Force Majeure: During your acceptance of Kocard services, you may encounter unexpected risks that cause service interruption due to force majeure or emergency avoidance, including but not limited to floods, earthquakes, epidemics, hurricanes, fires, wars, riots, government actions, hacker attacks, virus invasions, or technical adjustments by telecommunications departments. In such cases, Kocard will strive to cooperate with relevant forces to repair the issue immediately and minimize your losses.

Regulatory Compliance: In the event of emergencies, public gatherings, major national/foreign affairs, large-scale conferences/events, disaster relief, or important security tasks, and in accordance with the specific rules and spirit of applicable laws and regulations (such as the Regulations of the PRC on Information and Measures for the Administration of Internet Information Services), Kocard may—if conditions permit and after fulfilling reasonable notification obligations (via official website, email, WeChat, phone, SMS, etc.)—take measures such as filtering, screening, suspending, or discontinuing services. This is to cooperate with national efforts in maintaining network security and compliance, and to eliminate the possibility of content violating national laws and policies. You agree to support, understand, and provide necessary cooperation in this regard.

Maintenance Compensation: To maintain channel stability and improve quality, Kocard may overhaul, maintain, upgrade, or debug the Kocard SDK, channels, or other equipment. Before taking such measures, Kocard will fulfill reasonable notification obligations. For service interruptions or suspensions caused by this, Kocard may provide equivalent compensation, and you agree to support and cooperate with this.
Article 7. Governing Law and Jurisdiction

Governing Law: The understanding and application of this Agreement shall be consistent with the interpretation of the laws of the People's Republic of China (PRC). The validity, interpretation, modification, execution, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China. If there are no relevant legal provisions, general international commercial practices and industry practices shall be referenced.

Dispute Resolution: Any disputes arising from this Agreement shall be handled in accordance with the laws of the People's Republic of China. If specific terms of this service conflict with the laws of the People's Republic of China, those terms will be re-interpreted completely in accordance with the law, while other terms will remain binding on you and Kocard.

International Compliance: You understand and accept that the internet is borderless. You agree to comply with all applicable local laws, including but not limited to laws regarding online behavior and content publication. You specifically agree to comply with all applicable laws and regulations regarding the transmission of technical data exported from China or the country or region where you are located.
